These Terms of Service apply to enquiries, bookings and transport arrangements made with YH Private Sydney.

By making an enquiry, accepting a quote, confirming a booking, making payment or using our services, you agree to these Terms.

For the purposes of these Terms, “YH Private Sydney”, “YH Sydney”, “we”, “us” and “our” refers to the business operating the YH Private Sydney service, including its authorised representatives, drivers, contractors and approved service partners where applicable.

1. Our Service

YH Private Sydney arranges premium transport across Sydney for families, executives, hotel guests and hospitality partners.

Our services may include airport transfers, hotel guest transport, executive transfers, corporate drop-offs, family transport, private events, guest transport, recurring arrangements and selected vehicle viewings by showroom appointment.

Each arrangement is coordinated around the details provided by the client, including date, time, pickup location, destination, vehicle preference, itinerary, passenger requirements, luggage requirements, waiting time and the nature of the occasion.

2. Enquiries and Booking Confirmation

Submitting an enquiry through our website, email, WhatsApp, WeChat, phone or any other communication channel does not automatically create a confirmed booking.

A booking is only confirmed once we have accepted the booking, confirmed the relevant details, and any required deposit, prepayment, card authorisation, account approval or written confirmation has been received.

We may decline an enquiry or booking request at our discretion where the requested arrangement is unavailable, unsuitable, unsafe, incomplete, inconsistent with our service standards or unable to be properly coordinated.

The person making the booking is responsible for ensuring all booking details are complete and accurate. This includes the correct date, time, pickup location, destination, flight details where relevant, passenger numbers, luggage requirements, child restraint requirements, vehicle preference and any special instructions.

YH Private Sydney is not responsible for issues caused by incorrect, incomplete or late information provided by the client, passenger, hotel, concierge, assistant, event organiser or third party.

3. Quotes and Pricing

Pricing is tailored to the selected vehicle, date, time, duration, itinerary, pickup and destination locations, waiting time, event requirements, passenger requirements and level of service required.

A quote may include, where applicable, vehicle preparation, vehicle positioning, driver time, waiting time, travel time, route planning, coordination, parking, tolls, airport charges, special access requirements and other costs associated with the arrangement.

Unless otherwise stated in writing, a quote is valid only for the specific details provided at the time of quotation. A quote may change if the booking details change, including changes to timing, route, stops, passenger numbers, luggage requirements, waiting time, vehicle selection or itinerary.

Additional charges may apply for extended waiting time, additional stops, route changes, overtime, late-night or early-morning bookings, public holidays, peak periods, high-demand dates, event delays, additional coordination, parking, tolls, airport charges, cleaning, damage or other requirements not included in the original quote.

4. Payments

Payment terms will be confirmed at the time of booking.

We may require full payment, a deposit, card authorisation, account approval or other payment confirmation before a booking is confirmed.

For selected vehicles, private events, high-demand dates, hospitality partner arrangements, corporate bookings or recurring arrangements, payment may be required in advance.

Where invoicing has been approved by YH Private Sydney, invoices must be paid by the due date stated on the invoice. We may suspend, cancel or decline future bookings if invoices remain unpaid.

The client is responsible for all agreed fees, additional charges and reasonable recovery costs associated with unpaid or overdue amounts, to the extent permitted by law.

5. Changes, Additional Stops and Extensions

Clients must notify us as soon as possible if they need to change a booking.

Changes to the date, time, pickup location, destination, vehicle, passenger requirements, luggage requirements or itinerary are subject to availability and may result in additional charges.

Additional stops, extended waiting time, route changes, overtime or service extensions are subject to driver and vehicle availability and may incur additional charges.

Where the requested change affects a later booking, driver allocation, vehicle availability, event schedule or operational standard, we may decline the change or offer an alternative arrangement.

6. Cancellations and No-Shows

Cancellation terms may vary depending on the vehicle, booking type, date, time, itinerary and level of preparation required.

Clients must notify us as soon as possible if they need to cancel a confirmed booking.

Cancellation fees may apply where a booking is cancelled after confirmation, particularly where a vehicle, driver or other resources have been allocated, prepared or positioned for the booking.

Late cancellations, same-day cancellations and no-shows may be charged up to the full booking amount, depending on the circumstances and costs already incurred.

If a passenger does not attend the pickup location within a reasonable time and we cannot contact the client or passenger, the booking may be treated as a no-show and charged accordingly.

We will act reasonably when assessing cancellation and no-show matters, taking into account the timing of the cancellation, the nature of the booking, resources allocated and costs already incurred.

7. Waiting Time

Bookings are arranged around the agreed timing and itinerary.

Reasonable waiting time may be included where stated in the confirmed booking.

Additional waiting time may apply where the client, passenger, flight, event, venue, hotel, concierge team or third party causes a delay beyond the agreed arrangement.

Waiting time inclusions and any additional waiting time charges may vary depending on the pickup type, vehicle, itinerary, date, time and booking confirmation.

For airport arrivals, clients must provide accurate flight details where relevant. We may monitor flight timing where practical, but we are not responsible for delays caused by incorrect flight information, airport processing, baggage delays, customs delays, security restrictions or changes outside our control.

For hotel, event, family, corporate and private arrangements, clients must ensure passengers are ready at the agreed pickup time.

Where a passenger does not attend the pickup location within a reasonable time and we cannot contact the client or passenger, the booking may be treated as a no-show and charged accordingly.

8. Luggage and Vehicle Capacity

Clients must advise luggage requirements before booking so that an appropriate vehicle can be arranged.

Luggage capacity depends on the selected vehicle, passenger numbers and vehicle configuration.

If luggage exceeds the capacity of the selected vehicle, an additional or alternative vehicle may be required and additional charges may apply.

For safety, comfort and vehicle presentation reasons, luggage may not be permitted in the passenger seating area unless expressly approved by the driver.

We are not responsible for delays, vehicle changes or inability to transport luggage where luggage requirements were not properly disclosed before the booking was confirmed.

9. Children and Child Restraints

Where children are travelling, the client must advise us before the booking is confirmed.

Child restraint requirements must be arranged in advance and are subject to availability, vehicle suitability and applicable law.

Clients are responsible for providing accurate information about the child passenger’s age, size and any restraint requirements in sufficient time for the arrangement to be properly assessed.

We may decline, adjust or require an alternative vehicle for a booking where child passenger requirements have not been disclosed, cannot be safely accommodated or cannot be arranged in accordance with applicable law.

YH Private Sydney does not guarantee that child restraints will be available unless expressly confirmed in writing as part of the booking.

10. Passenger Conduct

Passengers must behave respectfully and safely at all times.

Passengers must comply with all reasonable directions from the driver, including directions relating to safety, vehicle care, seatbelts, pickup areas, drop-off areas, passenger behaviour and protection of the vehicle.

YH Private Sydney may refuse, suspend or terminate a service where a passenger behaves in a way that is unsafe, unlawful, threatening, aggressive, abusive, intoxicated, disorderly, damaging to the vehicle, disrespectful to the driver or inconsistent with the standard of service we provide.

If a service is refused, suspended or terminated due to passenger conduct, the client may remain responsible for the full booking amount and any additional costs incurred.

11. No Alcohol, Smoking or Prohibited Items

Alcohol is not permitted in YH Private Sydney vehicles unless we have expressly approved otherwise in writing before the booking.

Smoking, vaping and the use of illegal substances are strictly prohibited in all vehicles.

Food and drinks may be restricted depending on the vehicle and booking type. Any food, drink or item likely to stain, damage or affect the presentation of the vehicle may be refused.

Passengers must not bring unlawful, dangerous, offensive or inappropriate items into the vehicle.

The driver may refuse carriage of any item or passenger where there is a safety, legal, presentation or vehicle-care concern.

12. Vehicle Care, Cleaning and Damage

Clients and passengers are responsible for treating the vehicle with care.

The client may be charged for cleaning, repair, detailing, deodorising, lost time, replacement parts or other costs caused by passenger conduct, spills, stains, damage, smoking, vaping, food, drink, excessive mess, broken items or misuse of the vehicle.

Cleaning or damage fees may be charged where the condition of the vehicle is affected beyond ordinary use.

Where damage, cleaning or repair requirements affect subsequent bookings, the client may also be responsible for reasonable losses or costs arising from the vehicle being unavailable, to the extent permitted by law.

13. Seatbelts, Safety and Driver Discretion

Passengers must wear seatbelts where required by law.

Drivers must comply with applicable road rules and safety requirements. A driver will not be required to speed, drive unsafely, stop unlawfully, wait in restricted areas, overload the vehicle, carry unsafe items or perform any action that may breach the law or compromise safety.

The driver has discretion to determine whether a pickup, drop-off, stop, item, passenger condition or request is safe and lawful.

The client is responsible for ensuring children, dependants or vulnerable passengers are accompanied and supported appropriately unless a specific written arrangement has been agreed.

14. Vehicle Selection and Substitution

We will make reasonable efforts to provide the selected or requested vehicle where it has been confirmed.

However, we may substitute a vehicle where necessary due to availability, safety, maintenance, operational requirements, vehicle damage, traffic, breakdown, driver availability or circumstances outside our reasonable control.

Where substitution is required, we will aim to provide a suitable alternative having regard to the nature of the booking and the level of service requested.

15. Approved Drivers and Service Partners

YH Private Sydney may use approved drivers, contractors, vehicles or service partners to fulfil a booking where required.

Any approved driver, vehicle or service partner used will be selected having regard to the standard, nature and requirements of the booking.

The use of an approved service partner does not change the client’s responsibility to comply with these Terms.

16. Showroom Appointments

Selected vehicles may be viewed at our showroom by private appointment where helpful.

Showroom appointments are subject to availability and must be confirmed in advance.

The showroom address may be provided directly once an appointment or arrangement has been confirmed.

A showroom appointment does not guarantee vehicle availability for a requested booking date unless the booking has been separately confirmed.

17. Hospitality, Corporate and Third-Party Bookings

Where a booking is made by a hotel, concierge team, assistant, business, family office, event organiser or other third party on behalf of a passenger, the person or entity making the booking is responsible for providing accurate details and ensuring the passenger is aware of relevant booking requirements.

Unless otherwise agreed in writing, the person or entity making the booking is responsible for payment and for any additional costs, waiting time, cleaning, damage, cancellation fees or charges arising from the booking.

For recurring arrangements, corporate accounts or hospitality partner arrangements, additional written terms may apply.

18. Delays Outside Our Control

We will take reasonable steps to provide the service as confirmed.

However, we are not responsible for delays, interruptions or changes caused by events outside our reasonable control, including traffic, road closures, weather, accidents, police activity, security restrictions, airport delays, flight changes, event delays, vehicle breakdown, mechanical issues, illness, emergency conditions, acts of government, industrial action or other circumstances beyond our control.

Where delays occur, we will act reasonably and communicate with the client where practical.

19. Website and Communications

Information on our website is provided for general information and may change without notice.

While we aim to keep our website accurate and up to date, vehicle availability, pricing, service options and arrangements may vary.

Website enquiries, WhatsApp messages, emails and other communications are not confirmed bookings unless expressly confirmed by YH Private Sydney.

Clients must not use our website or communication channels for unlawful, misleading, abusive, harmful or unauthorised purposes.

20. Intellectual Property and Website Content

All content on our website, including text, images, design elements, logos, brand assets, layout and service descriptions, is owned by or licensed to YH Private Sydney unless otherwise stated.

You must not copy, reproduce, republish, distribute, scrape, modify or use our website content for commercial purposes without our prior written consent.

Competitors, aggregators, lead-generation businesses and other third parties must not use our website content, images, brand assets, service descriptions or business information for competitive, misleading, automated or unauthorised purposes.

21. Privacy

We collect and handle personal information in order to respond to enquiries, manage bookings, coordinate transport arrangements, communicate with clients and provide our services.

Personal information may include name, phone number, email address, booking details, pickup and destination information, passenger requirements and communication history.

Our handling of personal information is set out in our Privacy Policy.

22. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or protection that cannot be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.

Where our services are supplied to a consumer under the Australian Consumer Law, those services come with guarantees that cannot be excluded, including that services will be provided with due care and skill, will be reasonably fit for any purpose made known, and will be supplied within a reasonable time where no time is agreed.

To the extent permitted by law, and subject to any non-excludable rights, our liability is limited to the resupply of the services or the cost of having the services supplied again.

23. Liability

To the extent permitted by law, YH Private Sydney is not liable for indirect, consequential, incidental, special or economic loss, including loss of opportunity, loss of profit, loss of business, missed flights, missed appointments, missed events, travel disruption or loss arising from delays or circumstances outside our reasonable control.

This limitation does not apply to liability that cannot be excluded or limited under applicable law, including under the Australian Consumer Law.

24. Disputes

If a concern or dispute arises, the client should contact YH Private Sydney as soon as possible so that the matter can be reviewed.

Both parties agree to act reasonably and attempt to resolve the matter in good faith before commencing legal proceedings, except where urgent legal relief is required.

25. Changes to These Terms

We may update these Terms from time to time.

The version published on our website at the time of a booking or enquiry will generally apply to that booking or enquiry, unless otherwise agreed in writing.

26. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the courts of New South Wales and any courts entitled to hear appeals from those courts.
